1. TERMS OF SERVICE

This Terms of Service Agreement (“Agreement”) constitutes a legally binding agreement between the user (“User”) and Nawat Learning Company (“Nawat”, “Company”, “we”, “us”), governing access to and use of the Nawat Training website, Learning Management System (LMS), digital courses, live sessions, assessments, certification services, and related offerings (collectively, the “Platform”).

1.1 Definitions

“Platform” refers to all digital infrastructure, content, services, and live components provided by Nawat Training. “Content” includes videos, documents, slides, assessments, branding materials, downloadable files, and intellectual property. “Trainer” refers to any approved third-party instructor contracted to deliver courses via the Platform.

1.2 Legal Status & Scope

Nawat Training operates under Nawat Learning Company, registered in the State of Kuwait. This Agreement applies to all domestic and international Users accessing the Platform.

1.3 Eligibility

Users must be at least 18 years old or have verified parental/guardian consent. Nawat reserves the right to verify age and identity where necessary.

1.4 Account Security

Users are solely responsible for safeguarding login credentials. Account sharing, resale of access, or institutional misuse without written authorization is strictly prohibited.

1.5 Lifetime Access Policy

Upon full payment, Users receive lifetime access to purchased courses. Lifetime access is defined as access for as long as the specific course remains operational and hosted on the Platform. Nawat reserves the right to modify, update, archive, replace, or discontinue any course without liability.

1.6 Live Training & Attendance

Certain courses include live sessions. Attendance requirements may apply for CPD certification eligibility. Nawat reserves the right to reschedule or substitute trainers due to operational necessity.

1.7 CPD Certification

Certificates confirm completion of course requirements and awarded CPD hours only. They do not constitute academic degrees, professional licensure, regulatory endorsement, or guaranteed employment. Users are responsible for verifying recognition within their professional jurisdiction.

1.8 Payments & International Transactions

Payments are processed through secure third-party providers. Users are responsible for applicable taxes, transaction fees, and currency conversion charges. Access is granted only after confirmed payment.

1.9 Intellectual Property Rights

All Content is protected under applicable intellectual property laws. Unauthorized copying, reproduction, redistribution, public display, screen recording, or commercial use is strictly prohibited and may result in immediate termination and legal action.

1.10 External Trainers

External Trainers are contractually responsible for academic integrity of their content. Nawat retains distribution rights over approved materials hosted on the Platform.

1.11 Acceptable Use

Users shall not engage in unlawful, abusive, discriminatory, defamatory, fraudulent, or disruptive conduct. Any attempt to hack, reverse-engineer, scrape, or disrupt the Platform is prohibited.

1.12 Indemnification

Users agree to indemnify and hold harmless Nawat, its directors, officers, affiliates, and contractors from any claims, damages, liabilities, costs, or expenses arising from misuse of the Platform or violation of this Agreement.

1.13 Limitation of Liability

To the fullest extent permitted by law, Nawat shall not be liable for indirect, incidental, consequential, or special damages, including loss of income, business, data, or reputation arising from use of the Platform.

1.14 Force Majeure

Nawat shall not be liable for delays or failures resulting from events beyond reasonable control, including but not limited to natural disasters, governmental actions, technical outages, or global emergencies.

1.15 Dispute Resolution

This Agreement shall be governed by the laws of the State of Kuwait. Any dispute shall be subject to the exclusive jurisdiction of Kuwaiti courts. Nawat may, at its discretion, elect arbitration for international disputes under recognized arbitration rules.

1.16 Modifications

Nawat reserves the right to amend this Agreement at any time. Continued use of the Platform constitutes acceptance of updated terms.
